Gerald Mulder, et al. v. Venture Transport Logistics, LLC and Christopher Wills

Tried in November 2010, this case resulted in a $16,028,324 jury award in favor of the Crosley Law Firm’s clients.  The jury verdict included $10,000,000 in punitive damages.

The Defendants were Venture Transport and its truck driver, Christopher Wills.  The evidence at trial showed that Wills had been driving for several days and was in violation of numerous Federal Motor Carrier Safety Regulations.  For example, he had been falsifying his driver logs to make it look like he was in compliance with the Hours of Service regulations.  The evidence showed that Venture, or its terminal manager and dispatcher, should have known that Wills was driving over hours and was falsifying his logs. If Venture had reviewed the logs in accordance with industry safety standards as described by a trucking safety expert retained by Crosley Law Firm, then perhaps Wills would not have been allowed to remain behind the wheel.  Based on the evidence obtained by Crosley Law Firm, the truck driver was forced to admit that driver fatigue was the cause of the crash.

But Crosley Law Firm went a step further.  Despite two police officers at the the scene concluding that the truck driver was not intoxicated, Crosley Law Firm tracked down eyewitnesses from a nearby bar, Midnight Rodeo, who testified that the truck driver had been drinking there in the in the hours before the crash.

To prove our clients’ damages, a highly disputed “mild” brain injury, Crosley Law Firm spent hundreds of hours of research, traveled the country meeting with some of the top experts in brain injury, and very convincingly debunked all of the other side’s attempts to downplay the severity of our clients’ injuries.

The result was a case where the Defendants went from denying all responsiblity and refusing to settle two years earlier, to paying a record settlement!  (The final settlement after trial did not include the punitive damages, but did include virtually all the other damages awarded by the jury).
